TERMS AND CONDITIONS

In these Terms and Conditions, the following words and phrases shall have the following meanings:
“the Buyer / or you / or the customer” means the person, firm or company who purchases the Goods from the Company, Visual Candy:
“the Company / or we / or us / or our” means Visual Candy;
“Goods” means any goods (T-shirts) agreed in to be supplied by the Company to the Buyer;

OUR WEBSITE
You are not permitted to print or download extracts from this Website either for private or commercial use.

Unless otherwise stated, the copyright and other intellectual property rights in all material on this website (including without limitation photographs and graphical images) are owned by us or our licensors.

No part of this website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission.

We reserve the right to change, modify, remove or substitute without notice any products or information shown on the website from time to time. Prices and availability are subject to change.

Visual Candy does not control, endorse and is not responsible for the availability or content of any third party websites available via this website through an external link.

OUR T-SHIRT DESIGNS
Some of our T-shirts may offend. We do not accept responsiblilty for how or where the buyer chooses to wear their t-shirt.
If you would like to buy one of our t-shirts but you would like it censored, please contact us before ordering, we may or may not be able to, depending on each individual design. We do not accept responsibility for under 18's purchasing offensive t-shirts. We do advise that these are for adults only.

YOUR T-SHIRT DESIGNS
We offer a free t-shirt of your choice, any size / colour if we decide to use your submitted design in our store. It is at our discretion as to whether we use your design, we are not obliged to use all designs submitted. We do not accept responsibility for designs you submit that may infringe copywrite law or Intellectual property rights. By submitting your design to Visual Candy, you are agreeing that we are permitted to include this design in our store to sell at an unlimited quantity.

ORDERING
We reserve the right not to process any incomplete or incorrect orders. You will be notified by e-mail if your order is incomplete.

SAFE SHOPPING
The Visual Candy Shopping Guarantee protects you while you shop so that you never have to worry about credit card safety.  We guarantee that every transaction you make at Visual Candy will be 100% safe. We use RBS WorldPay to process all our credit and debit card orders. All payments are handled off-site using WorldPay's SSL. We also use PayPal to process our PayPal orders. SHIPPING
We do not charge for shipping if you live within the UK. All international orders will incur a shipping charge which is added to the basket during checkout. We reserve the right to cancel orders which are made from IP addresses in high risk fraudulent areas.

UK - Orders are usually dispatched via Royal Mail 1st Class Signed For within 5 working days of date of purchase however occasionally there may be a slight delay due to availability. If you have not received your items within 10 working days please contact us.

International - Orders are usually dispatched via Royal Mail International Signed For within 5 working days of purchase however occasionally there may be a slight delay due to availability.. If you live outside the UK, delivery times may vary. It can take up to 4 weeks weeks for you to receive your goods.

RISK IN AND OWNERSHIP OF GOODS
Risk in the Goods shall pass to the Buyer on delivery.
Ownership in the Goods shall not pass to the Buyer until the we have received in full in cleared funds all sums due to us in respect of the Goods.

PRICE
The price for the Goods shall, unless otherwise agreed, be the price set out on the website
The price for the Goods shall be inclusive of all costs of carriage and insurance and applicable VAT.
Our prices are periodically reviewed and are subject to change at our discretion.

PAYMENT
If you have arranged for your order to be invoiced, payment of the price of the Goods shall be due 30 days from the date of our invoice for the Goods. All other payments are to be made by credit or debit card.

Payment shall not be deemed to have taken place until we receive cleared funds.

CANCELLATIONS / REFUNDS / EXCHANGES
If you wish to cancel your order you may do so only before we have printed your t-shirt(s). Please contact us. If your request to cancel your order is made after we have printed your t-shirt but before we have dispatched it we shall refund your payment less our production costs.

All of our t-shirts are thoroughly checked before dispatch, to ensure our customers receive the highest quality garments.
If your t-shirt arrives scuffed or damaged (this may happen during shipping) please contact us within 7 days of receipt before returning your t-shirt and we will arrange to replace it with a new one. Replacements will be of the same size/colour as the returned one and will be dispatched only when we receive the damaged one.

All of our t-shirts are custom-printed, they are not off-the-shelf, so please check that all sizes and colours are correct before placing your order.

We will not refund/exchange:
If you have ordered the wrong colour.
If you bought it as a gift, but the recipient doesn't like it.

We will exchange:
If you have ordered the wrong size - your old t-shirt must be returned within 14 days of purchase.
If your t-shirt is damaged in transit (replacements will be of the same size/colour as the damaged one).
If we have made an error on your order e.g. we have sent you a size/colour not as your order states.

We will refund:
If we have made an error on your order e.g. we have sent you a size/colour not as your order states.
Please contact us within 7 days of receipt of your goods, if we receive a t-shirt that does not comply with our terms and conditions, that same t-shirt will be posted back to you or binned - with no refund.

If you have ordered the wrong size but would not like to exchange for another size we will refund any money less our production and postage costs.

If a t-shirt is returned to us undelivered we will refund any money less our production and postage costs.

We will not accept responsibility for goods being misplaced during its return to us. Please get adequate insurance / parcel tracking when returning goods.

LOOKING AFTER YOUR T-SHIRT
We periodically run quality tests on our t-shirts. As with all things there are some do's and don'ts when it comes to washing. We strongly advise you wash and iron your t-shirt as follows:

1. Wash your t-shirt at a maximum temperature of 40 degrees Celsius / 104 degrees Farenheit.

2. Do not use bleach or any form of bleaching agent.

3. Do not tumble dry your t-shirt.

4. Do not dry clean your t-shirt.

5. Iron your t-shirt at a medium temperature and always iron on the reverse.

By following the above advice you will gain the maximum amount of wear from your new t-shirt. All t-shirts come with a wash label explaining the above.

COMPETITIONS
Winners of our competitions are chosen at our discretion. Our monthly caption competition will usually end on the las day of the month. We reserve the right to bring forward or extend the finishing time. The winner will be notified by email within 48 hours of the competition ending. The winner will be entitled to a t-shirt of their choice which will be sent via Royal mail within 7 days of receipt of email noting such chosen prize.

DATA PROTECTION
In compliance with the Data Protection Act, your details will not be disclosed to any other organisation. However, we may occasionally contact you with promotions and competitions.

This store does collect demographic data and personal data to provide you with a better shopping experience.

Your personal details will remain private and confidential. We will never sell, rent, barter or share your personal details in any way with any other company. All data collected is for our internal use only.

We hate spam as much as you do. So, we will NEVER send you any unsolicited e-mail. If you choose to subscribe to our free newsletter, clear unsubscribe details are always shown within it.

If you choose not to receive our free newsletter, we will only contact you to answer your queries and/or send you your order confirmation. We will not contact you anytime else.

We may from time to time, send you pertinent information on special offers, giveaways or special discounts should you choose to subscribe to it. In any case, you will receive no more than one (1) e-mail a week.

This site does use cookies. However, we do not keep any of your personal details on cookies. We simply store your Customer ID (just a number) in cookie format. This Customer ID does not correlate to any of your personal information. We also store your first name on cookie format to personalise this website. This cookie is only present if you have not registered as a member of our site. If you are a member, then the only cookie that we use is the Customer ID cookie.

We may from time to time post up surveys to measure your response to certain new additions to the website. As a rule, you are never forced to fill in these surveys. Furthermore, should you choose to fill in the surveys, you can choose to remain anonymous.

Visual Candy will from time to time run free t-shirt competitions on our website. Any information entered through these competitions also complies with this privacy policy. We will never share your personal details with another company.

GENERAL
If any part of these Terms is found to be void or unenforceable by any Court of competent jurisdiction, such part shall be severed from these Terms which will otherwise remain in full force and effect. These Terms shall be governed by and interpreted according to English Law and the parties submit to the exclusive jurisdiction of the English Courts.
